LICENSING AGREEMENT

Upon the installation of any product from Great American Samples, you are agreeing to adhere to the licensing agreement outlined below:

  1. License Grant:

This product is licensed to a single user only. You are authorized to use this product on no more than two (2) distinct computers, both of which must be owned and utilized solely by you. Should you require usage on additional computers, tailored arrangements can be requested on an individual basis. All sounds and samples contained in this product are provided to you under license by Great American Samples for both commercial and non-commercial purposes in music production, sound effects, audio/video post-production, performance, broadcast, or any similar activity involving content creation and production. Great American Samples grants you the right to incorporate any sounds and samples from the libraries you have acquired into your commercial projects without the necessity to pay further license fees or attribute Great American Samples. This license is strictly non-transferrable and explicitly prohibits any form of resale or leasing of the product. Moreover, it strictly prohibits using the content from this or any other Great American Samples library in any other virtual instrument or sample library without our direct written approval. Redistribution of this product, or its sounds, by any means including re-sampling, mixing, processing, isolating, or embedding within any software or hardware for the purpose of recording or reproduction as part of any library of musical and/or sound effect samples or any playback system is expressly forbidden.

  1. Rights/Watermarking Policy:

The product and all associated documentation are protected under copyright laws and international copyright treaties, along with other intellectual property laws and treaties. Great American Samples maintains all rights and complete ownership over all recorded sounds, instrument programming, documentation, and musical performances included within the product. Any rights not expressly granted are reserved by Great American Samples.

Unauthorized use, distribution, or reproduction of the product is strictly prohibited and will be met with legal action, granting Great American Samples the right to seek injunctive relief among other legal remedies. It is illegal to intentionally bypass, modify, or remove any protective technological measures or information provided by Great American Samples that identifies the product, its ownership, and the terms and conditions of its use. The product contains a unique digital watermark tied to your serial number; misuse leading to the product appearing in others’ music makes you legally liable. It is requested that this product remains for your use only, and you are expected to take reasonable measures to prevent its unauthorized copying or use.

  1. Refunds:

All sales are definitive, and purchases are non-refundable. Please make your selections carefully.

  1. Limited Warranty/Limitation of Liability:

TO THE FULLEST EXTENT PERMITTED BY LAW, GREAT AMERICAN SAMPLES DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GREAT AMERICAN SAMPLES, ALONG WITH ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES ARISING FROM THE USE OF THE PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  1. Term:

This agreement takes effect upon the installation of the product and continues until terminated. Violation of any term or condition results in termination of the license, obligating you to destroy all copies and contents of the product at your expense. Sections 2, 3, 4, and 7 will survive termination.

  1. NFR (Not for Resale)/EDU (Educational) Sales:

All products from Great American Samples are governed by this license unless stated otherwise. NFR and EDU versions are not eligible for updates, upgrades, or further discounts. Products provided for educational purposes must only be used by students, faculty, or staff of educational institutions and are not for commercial use. Not all products may be available for the EDU Sales program.

  1. General Terms:

(a) Governed by the laws of California, this license is subject to the jurisdiction of state and federal courts in California, specifically Los Angeles County, for any disputes.

(b) This license represents the complete agreement between the parties on this matter, superseding all other communications.

(c) By installing this product, you acknowledge having read this agreement, understanding it, and agreeing to be bound by its terms and conditions.
